What to Do After a DUI Crash

You may already realize that there are certain steps to take after an auto accident, and there are additional tips when you suspect the other motorist is impaired. Generally speaking, your tasks relate to evidence: Gathering what you can at the scene, and protecting your evidence. As such, keep the following information in mind.
- As you would after any collision, if you are able to, use your cell phone to take pictures of the damage to vehicles, the roadway or intersection, traffic signage, and other physical characteristics.
- Call the Police
- If you are hurt, request emergency medical attention at the scene.
- Comply with your legal duty to exchange contact and insurance information.
- If the other driver apologizes or admits fault, ask for permission to record the other driver’s statement apologizing or admitting fault for causing the accident. If they consent, you might use your cell phone to record a video of their statement.
- Pay close attention to the other driver’s speech, mannerisms, and other indications of impairment. Note the odor of alcohol, bloodshot eyes, and any statements about drinking or using drugs.
- If you suspect the other driver may be under the influence of alcohol or other drugs, alert the police officer at the scene to the same, and request that they perform a breathalyzer on the at-fault driver.
- If contacted by an insurance company in the days after the crash, you should only confirm your name, address, and the date of the DUI accident. Do not make any statements, answer questions about fault, or inform the agent that its policyholder was drunk.
